User Agreement for the Lawyers Weekly Online Subscriber-Only Benefits
PLEASE READ THE TERMS AND CONDITIONS OF THIS AGREEMENT CAREFULLY.
1. Registration
By completing the Lawyers Weekly's
registration process, you become an authorized
user of Lawyers Weekly's subscriber-only areas. Access to the Lawyers
Weekly subscriber-only areas are included in your subscription and are for your individual use only. The subscriber-only areas include features on the Lawyers Weekly Website which require a username and password to access as well as any email services provided by Lawyers Weekly. Under these terms you agree not to share your username and password and agree not to forward our Daily Email Alert, Weekly Practice Alert, Preview Alert, or Rules Service Alert.
This User Agreement
governs your access to Lawyers Weekly's subscriber-only areas
and use of the documents you retrieve through
Lawyers Weekly's subscriber-only areas and is the entire agreement
between you and Lawyers Weekly Inc. relating to
Lawyers Weekly's subscriber-only areas.
This User Agreement applies to all users of the Lawyers Weekly Website's subscriber-only areas, including users who subscribe through the 3 Free Issues offer. Note that you may only participate in the 3 Free Issues offer once per calendar year.
If you do not agree with the terms and conditions
of the User Agreement, you will not be provided
access to Lawyers Weekly's subscriber-only areas. By clicking
on the "I Agree" button and using Lawyers Weekly's
subscriber-only areas, you agree to be bound by the terms and
conditions of the Lawyers Weekly's subscriber-only areas User
Agreement.
2. Modifications
Lawyers Weekly Inc. may, at any time, amend the
Lawyers Weekly's User Agreement and
modify, enhance or delete databases, features and
services available on or through Lawyers Weekly's
subscriber-only areas. The amended User Agreement will be made
available online and will be effective immediately
upon Lawyers Weekly Inc.'s posting.
BY ACKNOWLEDGING YOUR ACCEPTANCE OF THE AMENDED
USER AGREEMENT OR BY USING LAWYERS WEEKLY'S
SUBSCRIBER-ONLY AREAS AFTER ANY AMENDMENT BY LAWYERS WEEKLY
INC., YOU AGREE TO BE BOUND BY THE LAWYERS
WEEKLY'S USER AGREEMENT AS AMENDED.
If at any time you disagree with the terms and
conditions of the User Agreement, you may
terminate your Lawyers Weekly's subscriber-only areas access
as provided in Section 7 below.
3. License
You may use the Documents solely in the regular
course of your business, research and other
related work, such as your review of the Documents
or the incorporation of portions of a Document in
your own work product. You must retain the copyright
and other source-identification notices included
with the Documents. You may not copy or distribute
the Documents nor may you sell or license the
Documents or use the Documents as a component
of any commercial material. You may not forward any of the email services provided by Lawyers Weekly. If you are interested in obtaining permission to use our content click here for price and contact information.
4. Title
Except for the license granted herein, all right,
title and interest in the Documents (including all
copyrights therein) are and shall continue to be
the exclusive property of Lawyers Weekly Inc., or
other contributors of Documents.
5. No Assignment
You may not assign, sublicense or otherwise
transfer this Agreement or any part of it to a
third party without Lawyers Weekly Inc.'s prior
written consent. You are responsible for all
access to and use of Lawyers Weekly's subscriber-only areas
by means of your user name and password, even
if you did not know of or authorize such access
and use. You may not share your password, nor share access to any Lawyers Weekly e-mail alert through the use of forwarding.
Libraries, including law firm libraries, are subject to the same general restrictions in that you are not permitted to share the password, use your password to perform searches for the attorneys at the firm or for patrons of the library, or forward subscriber-only email alerts (the Daily Alert, Practice Area Alerts, Preview Alerts, or Rules Service Alerts). In the case of the Massachusetts Rules Service only, there is an exception in that librarians may perform searches for the attorneys at the firm or for patrons of the library. However, you may not share the password or forward subscriber-only e-mails.
6. DISCLAIMER OF WARRANTIES AND
LIMITATIONS OF LIABILITY
LAWYERS WEEKLY'S SUBSCRIBER-ONLY AREAS
AND THE DOCUMENTS ARE PROVIDED "AS IS," WITHOUT
WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING,
BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE. LAWYERS WEEKLY
INC. MAKES NO WARRANTIES OR REPRESENTATIONS TO YOU
(i) THAT YOUR ACCESS TO LAWYERS WEEKLY'S SUBSCRIBER-ONLY AREAS
OR THE DOCUMENTS WILL BE UNINTERRUPTED OR FREE
OF ERROR, OR (ii) AS TO THE ACCURACY, COMPLETENESS
OR CURRENCY OF LAWYERS WEEKLY'S SUBSCRIBER-ONLY AREAS OR THE
DOCUMENTS. YOUR EXCLUSIVE REMEDY AND LAWYERS WEEKLY
INC.'S AND/OR CONTRIBUTORS'ENTIRE LIABILITY HEREUNDER,
IF ANY, FOR ANY CLAIM(S) FOR DAMAGES AGAINST THEM,
INDIVIDUALLY OR JOINTLY, WHETHER BASED IN CONTRACT
OR NEGLIGENCE, SHALL BE LIMITED TO THE AMOUNT OF
CHARGES PAID BY YOU TO LAWYERS WEEKLY INC. UNDER
THIS AGREEMENT; PROVIDED, HOWEVER, THAT IN NO
EVENT WILL LAWYERS WEEKLY INC. BE LIABLE FOR ANY
LOST PROFITS OR OTHER CONSEQUENTIAL, EXEMPLARY,
INCIDENTAL, INDIRECT OR SPECIAL DAMAGES RELATING
IN WHOLE OR IN PART TO YOUR RIGHTS HEREUNDER OF
THE USE OF, OR INABILITY TO USE, LAWYERS WEEKLY'S
SUBSCRIBER-ONLY AREAS OR DOCUMENTS, EVEN IF ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
7. Termination
You may terminate this Agreement and your access
to Lawyers Weekly's subscriber-only areas at any time by
providing notice of termination to Lawyers Weekly
Inc. by e-mail at: orders@lawyersweekly.com or by
United States mail at:

Lawyers Weekly Inc. may terminate the User
Agreement and your access to Lawyers Weekly's
subscriber-only areas at its sole arbitrary discretion.
It will give you (i) written or online notice
of termination if you commit a material breach
of this Agreement or if Lawyers Weekly Inc.
determines you are ineligible to use Lawyers
Weekly's subscriber-only areas. Sections 4 Title and 6
DISCLAIMER OF WARRANTIES AND LIMITATION OF
LIABILITY shall survive any termination of
this Agreement.
8. General Provisions
This User Agreement will be governed by the laws
of the State of Massachusetts. If any provision of
the Agreement is determined by a court to be void,
invalid, unenforceable or illegal, the
enforceability of the other provisions of the
Agreement will not be affected. Failure to enforce
any provision of this User Agreement will not
constitute a waiver of the right to later enforce
it. You agree to provide Lawyers Weekly Inc. with
accurate and complete information necessary to
process your Lawyers Weekly's subscriber-only areas
registration and to promptly notify Lawyers Weekly
Inc. of any changes in such information. Failure
to do so will constitute a material breach of this
Agreement,for which Lawyers Weekly Inc. will have
the right to terminate your access to Lawyers Weekly's
subscriber-only areas under Section 7 above.
